Webinar: Back to School — Preparing for Legal Challenges in Higher Education

As students return to school, colleges and universities must be prepared for classes, sporting events and other activities to resume to a somewhat normal standard. And with that normalcy, come challenges and issues that higher educational institutions must face into, keeping students and faculty safe and operations running smoothly. In preparation for the new school year, Warner presented a complimentary 90-minute webinar to prepare you and your teams for whatever legal challenges are around the corner. Here is the breakdown of topics that we covered: 

STUDENT LIFE: (30 minutes) 

Gender Issues on Campus: Title IX, Student Housing/Facilities, Athletics & Speech

With the change in federal administrations, we are seeing a shift in how the Office of Civil Rights will approach gender-related issues. Jason and Kelsey will provide an overview of that shift and discuss the interplay with recent and upcoming court cases that effect the legal landscape in this area.

Vaccine Mandates

Can colleges and universities mandate students and staff to get vaccinated? What legal parameters must you stay within when developing policies and procedures regarding vaccination requirements? Jason covers these million dollar questions and provides guidelines for higher educational institutions to follow.

Copyright/Fair Use in Course Materials

Educational purpose is an important factor in creating “fair use” of a copyright work, but it is not the only factor. As result, a university or college cannot assume that every use it makes of a copyright work qualifies as fair use and attention must be paid to this issue or liability for significant monetary damages may result. Scott and Amber will discuss the other factors involved and provide guidelines on when fair use will apply.

Cyber Insurance policies offer a tool to mitigate against the risk of a data breach or Ransomware attack. Jason will review the key aspects of such policies and how they could be used by colleges and universities.
