New Bill Ends Presidential National Emergency – What That Means for Employers

Today’s Warner Employment News from the Law Shanty discusses employee benefits and specifically the Presidential National Emergency and the Public Health Emergency that were put in place during the COVID-19 pandemic. Steve Palazzolo facilitates this discussion with Warner attorneys Stephanie Grant and Brandon Cross regarding Monday’s bill that was signed into legislation by President Joe Biden to end the Presidential National Emergency effective on April 10, 2023. Although this bill ends the Presidential National Emergency earlier than its original May 11, 2023, end date, it does not end the Public Health Emergency, which is a different set of rules and guidelines set forth by the U.S. Department of Health and Human Services. Stephanie and Brandon address the differences between the two emergencies and the deadlines impacting employers now that the Presidential National Emergency has officially ended.

Warner’s Employee Benefits Practice Group issued an eAlert titled Benefit Plan Guidance for the End of the Public Health Emergency and “Outbreak Period” referenced in this Law Shanty episode on April 6, 2023. This Law Shanty episode is in follow up to that eAlert.
