MSC Order List: June 29, 2011

On June 29, 2011, the Michigan Supreme Court denied 143 complaints and applications for leave to appeal, and it denied 16 motions for reconsideration. In one case, the court granted the motion to strike a defendant's supplemental brief but denied the motion to strike the plaintiff's supplemental brief. In People v. Sims, No. 142868, the court entered an order reversing in part the Court of Appeals judgment because its order for resentencing was error. The Michigan Supreme Court held that resentencing is not required if the inaccurate score does not affect the applicable sentencing guidelines range. It denied leave to appeal in all other respects. In People v. Sherman, No. 142722, in lieu of granting leave, the Court remanded to the circuit court for it to direct the probation officer to purge from the presentence investigation report all challenged statements not taken into account by the judge during sentencing. Finally, the court held the application in Ruggin v. Auto Club Insurance Co., No. 142630, in abeyance pending its decision in Miller v. Detroit Medical Center, No. 141747.
