New Overtime Rules Getting Closer

The proposed new Fair Labor Standards Act (FLSA) rules were sent to the Office of Management and Budget (OMB) Monday for final review, with implementation expected later this year. The window of opportunity is rapidly closing for employers to take action before the new rules go into effect.

These are key questions that employers should ask themselves:

  • Do we have salaried exempt employees earning less than $50,440 per year?
  • Do we have independent contractors who should be classified as employees?
  • Do we have salaried employees performing ministerial duties?
  • Has it been several years since we’ve reviewed the exempt status of our job classifications?
