LEO’s Key Updates on ESTA

Steve Palazzolo and Anne Steen are back with an impromptu Law Shanty episode, breaking down the Michigan Department of Labor and Economic Opportunity’s (LEO) latest guidance on key provisions of the Earned Sick Time Act (ESTA). This new information clarifies several critical questions, including:

  1. On-call and Flexible Workers – Does ESTA apply to employees who set their own schedules?
  2. Sick Time Between Jan. 1 – Feb. 21, 2025 – Can employers “take credit” for time they gave employees on Jan. 1 toward the ESTA requirements?
  3. 120-Day Waiting Period for New Employees – Is this available for all employers, or does it only apply to those using the accrual method?
