Mr. Kohl focuses his practice on permitting, compliance and defense of the federal Clean Air Act and state air pollution control laws. He regularly counsels clients on matters under the New Source Review, NSPS, NESHAP and Title V provisions of the Clean Air Act.

He has nearly three decades of broad national experience in environmental law and litigation, having represented manufacturers in the chemical, automotive, utility and cement industries. Mr. Kohl is admitted to practice in multiple federal district and circuit courts and has tried and argued cases arising under CERCLA, the Clean Air Act, RCRA, and the Clean Water Act.

Representative Experience

  • Negotiating a nationwide settlement under the Clean Air Act for an international manufacturer
  • Developing comments to proposed rules under §§ 111 and 112 of the Clean Air Act
  • Successfully challenging terms and conditions of an air construction permit
  • Successfully challenging state agency rulemaking
  • Assisting a client in the development of one of the first GHG BACT analysis for a major source
  • Assisting a client in the development of an air permit application for a 600 MW electric generation facility
