Steve Kohl focuses his practice on permitting, compliance and defense of the federal Clean Air Act and state air pollution control laws. He regularly counsels clients on matters under the New Source Review, NSPS, NESHAP and Title V provisions of the Clean Air Act. He has nearly three decades of broad national experience in environmental law and litigation in multiple industries, including chemical manufacturing, automotive, utility and cement.  Steve is admitted to practice in multiple federal district and circuit courts and has tried and argued cases arising under CERCLA, the Clean Air Act, RCRA, and the Clean Water Act in the federal courts.

  • Compromise and settlement of federal Clean Air Act enforcement actions, including negotiation of a nationwide settlement for an international manufacturer
  • Participation in federal rulemakings under the Clean Air Act, including commenting upon and litigating NSPS and NESHAP rulemaking
  • Negotiation and litigation of PSD and Non-Attainment NSR Permits, including fossil fuel EGUs
  • Judicial challenges state agency rulemaking
  • Developing the first GHG BACT determinations for cement kilns and solid fossil fuel fired boilers
