Brian Lang welcomes the opportunity to resolve any complex dispute.  He focuses his practice on real estate and commercial litigation, and has successfully represented domestic and international clients as lead counsel in trial, arbitrations, negotiations and mediations. He regularly appears in matters pending in Michigan’s Circuit Courts and its administrative agencies as well as Federal Court. He also serves on the firm's Management Committee.
Brian formed and chairs the firm’s Real Estate Litigation Practice Group. His own real estate litigation practice extends to disputes regarding commercial tenancy and leases, boundary lines, riparian boundary lines, marinas and docks, administrative appeals, architect negligence, commissions, zoning, land use, historical designations and uses, development disputes, restrictive covenants, purchase agreements and land contracts, adverse possession, easements, fraudulent transfers, Michigan’s Builder’s Trust Fund Act, partition, quiet title, homeowner’s association disputes, receiverships as well as real estate issues that arise in trust and estate proceedings. 
Brian’s commercial litigation practice extends to disputes concerning breach of commercial contracts related to the supply of products and services, supply chain, business break-ups, shareholder and member oppression, buy-sells, earn outs, non-competes and fraud. In the past, his practice has often involved matters concerning cross border parties and issues.  Brian has traveled extensively in Asia, Europe, Africa and Central America, which informs his understanding of different cultures and doing business abroad.

  • Frequently represents clients in a wide array of commercial lease disputes related to lease options, issues that arise upon termination of tenancy and the like
  • Represents marinas in relationship to riparian rights, riparian boundary line disputes and permitting issues
  • Frequently assists cottage and lake front owners concerning riparian rights, adverse possession, access issues and boundary line disputes
  • Secured settlement in decades long dispute related to access to lake front property over Township park
  • Represents clients in administrative appeals from local historic district commissions to Michigan’s State Historic Preservation Review Board
  • Represents clients before MDEQ defending state issued permits
  • Regularly represents owners in disputes with architects and contractors
  • Regularly defends trustees in claims by beneficiaries
  • Obtained favorable judgment after trial recognizing unsigned trust amendment granting real property to client as effective under Michigan’s new Estate and Protected Individuals Code
General Commercial Litigation
  • Successfully represented OEM in litigation in Western District of Michigan, recovering equipment worth more than $300 million
  • Obtained favorable judgment after trial for industrial distributor in breach of warranty case against principals of computer consulting company
  • Secured favorable settlement for manufacturer of robotic assembly lines in collection suit and defended it in warranty claim by purchaser
  • Represented the Muskegon Museum of Art as it transitioned from public school ownership to a private foundation
  • Successfully represented trustees of multimillion dollar foundation who sought to break apart foundation to relieve internal strife
  • Obtained favorable settlement for sellers of technology business  engaged in dispute over earn out provision
  • Successfully represented shareholder in recovering business from equal shareholder and avoiding non-compete covenant
International Dispute Resolution
  • Successfully represented Illinois company in litigation in the District Court of Vermont, securing payment from 3M Gulf in the United Arab Emirates for concrete product
  • Managed litigation in England for Tier 1 Michigan supplier in litigation against supplier of defective electronic parts resulting in OEM’s recall
  • Resolved litigation for German supplier of electronic storage cabinets in dispute with a Michigan municipality
  • Coordinated removal of tooling from Mexican supplier and secured its return to U.S. manufacturer
  • Obtained favorable settlement for Chinese automobile seating company seeking to exit alleged agency agreement with Michigan company
  • Represented clothing manufacturer regarding quality claim against manufacturer in Pakistan when payment was to be made by irrevocable letter of credit
  • Represented Michigan company in suit against president of its Korean subsidiary for using subsidiary and taking its business for the benefit of a competitor
  • Resolved greenhouse’s claim against reinsurer concerning diseased plants from South Africa
  • Secured favorable settlement for Michigan manufacturer of conveyor belts, terminating supply agreement with a German supplier
  • Successfully represented Michigan company in collection suit against Canadian company before the International Centre for Dispute Resolution
