Scott Hubbard has been practicing environmental law for 30 years. A former chair of the firm's Resources, Energy and Environment Group, Scott counsels industrial, retail and municipal clients on environmental liability, compliance and planning issues. Scott's areas of expertise include the acquisition, management and financing of contaminated property, negotiation of environmental cleanups, compliance auditing and defense of agency enforcement proceedings.

  • Routinely counsels commercial banks and other lenders on environmental liability issues in loan review and workout/foreclosure contexts.
  • Development and negotiation of private industrial wastewater management agreements.
  • Negotiated major NPDES permits and groundwater discharge permits in paper, leather tanning, food and other industries, and for municipal facilities.
  • Advised major retailing client on management of historically impacted soils on new development site.
  • Knowledgeable on storm water permitting and management standards for construction sites.
  • Represented the Michigan Manufacturers Association on a statewide advisory committee on quantification of wastewater pollutants.
  • Represented industrial NPDES permittee in phosphorus TMDL work group and associated appearances before agency.
  • Successfully defended administrative challenges to major chemical company NPDES permit brought by nationally sponsored environmental organization.
  • Regularly represents industrial users in dealings with municipal wastewater authorities.
  • Developed wastewater reporting procedure manual for major automotive manufacturer.
  • Counseled national companies on Safe Drinking Water Act compliance, including coordination of communications with employees and other users of impacted SDWA public water supply systems.
  • SDWA compliance planning for water service extensions, both as replacement supplies for impacted groundwater and for new commercial developments.
  • Represented major automotive manufacturer in challenge to TMDL-based limits in NPDES permit.
  • Negotiated host community agreements on behalf of public and private landfill operators.
  • Represented solid waste landfills and haulers before county solid waste planning authorities.
  • Represented landfill in developing gas-to-energy project with independent power supplier.
  • Drafting and negotiation of disposal contracts and tipping fee arrangements among solid waste generators, haulers and landfill operators.
