EEOC Pay Data Collection on Hold

On August 29th, the Office of Management and Budget (OMB) informed the Equal Employment Opportunity Commission (EEOC) that it is initiating a review and immediate stay of the EEOC’s collection of information on pay data for the EEO-1 form. If the proposed new rules would have taken effect, all businesses with 100 or more workers would have been required to submit pay data by gender, race and ethnicity on the EEO-1 form by March 31, 2018.

The OMB on Tuesday said that while the EEOC may continue to use its previously approved form, the revisions that call for data on wages and hours worked from certain employers need a second look, calling some aspects of the recently expanded collection “unnecessarily burdensome.” The previously approved EEO-1 form which collects data on race, ethnicity and gender by occupational category will remain in effect. Employers should plan to comply with the earlier approved EEO-1 (Component 1) by the previously set filing date of March 2018.
