Members of our Employee Benefits Litigation Group strive to help employers avoid the litigation process as a whole. To achieve that, members of Warner’s EB litigation team work with employers to establish appropriate claims procedures and appeals processes before problems arise. When a troublesome claim does arise, our attorneys can help you evaluate the claim and possible resolutions. Our attorneys have worked with employers, third party administrators and insurers, and our experience enables us to counsel our clients on what works best for their specific situations.

An effective claims procedure and appeal process often is the key to heading off costly and time-consuming court battles. But if a complaint seems destined for litigation, our attorneys can help you posture the claim during the appeals process in order to get the most favorable review by a trial court. And if litigation follows, we will vigorously defend the claim with the goal of achieving a favorable outcome.

Our attorneys are well versed in employee benefits disputes, including claims for benefits under ERISA plans, ESOP matters, third party administration disputes, professional negligence, breach of fiduciary duty claims, and termination of retiree benefits. And if you have a dispute with an insurer, we have an established insurance litigation group and many years of experience representing policyholders in suits against insurance companies.

  • Represented international manufacturer in arbitration regarding dispute over ESOP plan benefits. Arbitrators sided with our client.
  • Represented third party administrator in suit alleging professional negligence, breach of fiduciary duty and state statutory claims. Most counts were dismissed and a favorable settlement was reached.
  • Represented numerous major manufacturers in termination of retirement benefits claims, resulting in favorable outcomes for our clients.
  • Successfully defended international automotive supplier in several employment discrimination matters.
  • Worked with some of West Michigan’s largest employers in developing summary plan descriptions and other disclosure documents to effectively communicate claims procedure disclosures required under ERISA.
