Circuit Court Blocks Regional Authority for Cobo Center; COA grants expedited review

Yesterday, Wayne County Circuit Court Judge Isidore Torres issued an order concluding that Detroit Mayor Ken Cockrel, Jr., did not have the authority to veto the Detroit City Council's rejection of a regional authority for Cobo Center. After waiting weeks in the hope that the city council and the mayor would resolve their disagreement, the court issued an order explaining that the Regional Convention Facility Authority Act, MCL ' 141.1351 does not authorize a mayoral veto of the council's resolution rejecting the transfer of Cobo Center to the regional authority. The court concluded that the Act's silence as to whether the mayor could veto the council's rejection of the transfer did not give the mayor authority to do so. The court granted declaratory judgment to the council and closed the case. Mayor Cockrel has promised to pursue expedited review by the Court of Appeals.
