Warner Norcross Helps Clients Identify, Capture Economic Incentives with New Practice Group

In order to better identify, coordinate and maximize financial incentives available to businesses looking to locate or to expand in Michigan, Warner Norcross & Judd LLP has established the Economic Development Incentives Group.

The group, which includes skilled attorneys from practice areas throughout the Firm, works to help companies navigate through the 50+ federal, state and local incentive programs and tax breaks to spur development and create jobs. In the past decade, Warner Norcross attorneys have secured more than $500 million in direct incentives for clients.

Partners John V. Byl and Kurt M. Brauer cochair the group, which draws its members from the Firm’s environmental, real estate, government affairs, tax, commercial finance, entertainment and other practice groups. The EDIG group has experience in:

  • Tax increment financing
  • Tax credits
  • Tax abatements and exemptions
  • Joint federal and state tax credit programs
  • Grants
  • Low-interest loans
  • Public and private bond programs
  • Federal stimulus package programs

"Our team is adept at finding and maximizing credits and incentives for our clients," Byl said. Our goal is to make sure that all possible avenues are explored."

Brauer agreed, noting: "Our attorneys have been instrumental in writing much of the legislation pertaining to economic incentives in Michigan, which has allowed us to cultivate key contacts within the economic development community and state government. This gives our attorneys, like John Byl, who was crucial to drafting the Brownfield Redevelopment Financing Act, an extra edge when advocating for our clients."

Byl and Brauer said that members of the EDIG meet with clients during the pre-project planning phase to evaluate the project before developing an appropriate blend of incentives that will work within the company’s timeline and budget. The process continues during construction to ensure that all program requirements are being met. At the close of a project, Warner attorneys will assist with securing, transferring or selling available credits.
