Brian Lang welcomes the opportunity to resolve any complex dispute but focuses primarily on real estate and commercial litigation. Whether in negotiations, at trial or through mediation or arbitration, he serves as lead counsel, successfully representing domestic and international clients in Michigan’s Circuit Courts and administrative agencies, as well as Federal Court. His practice regularly comprises cross-border issues and parties.

Real Estate Litigation

  • Obtained early dismissal for commercial land owner of municipal condemnation action due to municipality’s failure to comply with Michigan’s Uniform Condemnation Procedures Act.
  • Won substantial attorney fee award following dismissal in a lease dispute regarding commercial tenant’s attempted exercise of an option to purchase.
  • Secured favorable judgment after trial recognizing unsigned trust amendment granting real property to client as effective under Michigan’s amended Estate and Protected Individuals Code.
  • Won dismissal of action by neighbor seeking tear down of three story parking garage claiming violations of local zoning.
  • Represented bond insurer in advocating for its substantial financia

Real Estate Litigation

General Commercial Litigation

  • Successfully represented OEM in litigation in Western District of Michigan, recovering equipment worth more than $300 million.
  • Obtained favorable judgment after trial for industrial distributor in breach of warranty case against principals of computer consulting company.
  • Represented the Muskegon Museum of Art as it transitioned from public school ownership to a private foundation.
  • Successfully represented trustees of multimillion dollar foundation who sought to break apart foundation to relieve internal strife.

International Dispute Resolution

  • Successfully represented Illinois company in litigation in the District Court of Vermont, securing payment from 3M Gulf in the United Arab Emirates for concrete product.
  • Managed litigation in England for Tier 1 Michigan supplier in litigation against supplier of defective electronic parts resulting in OEM’s recall.
  • Represented Michigan company in suit against president of its Korean subsidiary for using subsidiary and taking its business for the benefit of a competitor.
  • Secured favorable settlement for Michigan manufacturer of conveyor belts, terminating supply agreement with a German supplier.
