Crain’s Detroit Business quotes Tom Manganello on GM ignition recall


The March 23 issue of Crain’s Detroit Business quotes Warner Norcross & Judd’s Tom Manganello in an article about General Motors’ recall of vehicles with faulty ignitions.

The article, titled “GM ignition recall may haunt Delphi,” questions the extent to which GM and Delphi are liable for the faulty ignitions since the products were installed before each company emerged from its respective bankruptcy. Under the Chapter 11 bankruptcy code, companies are protected from certain product liability obligations occurring prior to bankruptcy.

Manganello, who leads Warner’s Automotive Industry Group, discussed potential settlement options in the case.

“GM’s goal is the put this issue behind them, and the only way to do that via the settlement route would be to require all claimants to sign a waiver releasing GM and its entire supply chain,” Manganello said.
