Sustainable Business Operations

Warner Norcross & Judd’s Sustainable Business Operations group can assist your company with the creation, certification and protection of sustainable/green products.

From product conception through marketing and sales, Warner's multidisciplinary approach can provide the legal expertise you need. Our environmental, corporate and litigation attorneys work together to identify potential risks associated with sustainable products. Warner's intellectual property attorneys will ensure that your ideas, taglines and products are protected with the proper patents, trademarks or copyrights.

Our attorneys can help determine if your products meet environmental certification requirements. Many businesses are currently marketing products as "all natural," "environmentally friendly," "organic" or "100% recyclable." Given the complexity of these requirements, it is not surprising that some products have been improperly labeled.

Our attorneys can also help you interpret the evolving industry certifications, such as Forest Stewardship Council, USDA Organic, Energy Star and the Business and Institutional Furniture Manufacturers Association (BIFMA) furniture sustainability standard. To qualify for many of these certifications, your company must have in-depth information on the product's components.
We will work with your organization to develop claim substantiation processes that reduce the risk of challenges by competitors, the Better Business Bureau or the Federal Trade Commission.

In the event that your green marketing is the subject of litigation or arbitration, Warner has extensive experience resolving these disputes. We have defended injunctions and, if necessary, can obtain an injunction against a competitor.
