Cleanup Law

We coordinate environmental investigation of properties and assist clients in structuring transactions to address known and unknown environmental risks. We regularly review due diligence documents, including Baseline Environmental Assessments, and conduct environmental due diligence in major commercial transactions.

We also assist in dealing with contamination and cleanup issues associated with currently owned properties. For example, we were the first law firm in Michigan to obtain a clean closure certification from the Michigan Department of Natural Resources for a commercial hazardous waste disposal facility. We also obtained a court order requiring the U.S. Department of Defense to pay environmental cleanup costs at several Superfund sites.

The following are two representative cases we handled involving these matters.

  • Secured summary disposition triggering policy limits insurance coverage for a multimillion-dollar environmental cleanup. Pacific Insurance Co. v. Cordova Chem. Co., No. 115236 (Mich. Ct. App. 1990).

  • Successfully prosecuted a claim for insurance coverage for multimillion-dollar environmental contamination cleanup. Higgins Industries v. Fireman’s Fund, 1:87-cv-10406-SN-MLG (E.D. Mich. 1992).
