NHTSA Relaxes its 'One Stop Shop' Proposal for Recall Information

In January, we alerted you to a fairly burdensome rule proposed by the National Highway Traffic Safety Administration (NHTSA) in response to a congressional directive that NHTSA ensure individualized vehicle recall information be made publicly available on the Internet in a database searchable by vehicle identification number (VIN).   NHTSA’s proposed rule – a centralized database available on safercar.gov – required an OEM to submit VINs and recall information to NHTSA every single day for 10 years in an electronic format dictated by the agency. Fortunately, NHTSA issued a final rule last week that eliminates the most onerous requirements of its proposed rule without sacrificing consumer safety.  Under NHTSA’s final rule, rather than create a separate centralized database, NHTSA will simply provide a hyperlink on safercar.gov to each OEM’s individual website.  Each OEM must provide a VIN-based recall lookup tool on its website or a third-party website, and provide a hyperlink to that search tool on its main web page.  Instead of daily updates to recall data by VIN, NHTSA’s final rule only requires updates every 7 days.  Since most OEMs already collect recall data by VIN and provide VIN-based search functionality on their websites, complying with NHTSA’s final rule should require only minor changes to an OEM’s existing website, if any.  In fact, aside from the weekly updates, most of the legwork required by NHTSA’s final rule appears to fall on NHTSA itself in the form of updates to safercar.gov.  Review the final rule in its entirety here:  http://www.regulations.gov/#!docketDetail;D=NHTSA-2012-0068;dct=FR%252BPR%252BN%252BO%252BSR.
